Title IX and Sex Discrimination Information
Reporting Sexual Misconduct to the College

The Title IX Coordinator is responsible for taking reports and providing information about resources and services. Individuals who have experienced sexual misconduct should contact the Title IX Coordinator right away, although reports may be made at any time. Prompt reporting maximizes the College’s ability to respond and to take appropriate action. Individuals who have witnessed or have knowledge about an incident of sexual misconduct may make a report as well.

Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance. Title IX states that: "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance." -U.S. Department of Education

Montgomery College is committed to equal opportunity that assures access, equity, and diversity in its educational programs and activities. The College prohibits discrimination against any person on the basis of age, color, citizenship status, current or former military status, disability, gender, gender identity and expression, genetic information, national origin, marital status, race, religion, sex, or sexual orientation.

Sexual misconduct will not be tolerated and the College will consider any violation as a significant act of misconduct that will result in disciplinary action. When made aware through a formal complaint, the College will take immediate action to stop sexual misconduct and to ensure equal educational access of the parties. The College will treat complainants and respondents equitably, meaning that for a complainant, the College will offer supportive measures, and for a respondent, the College will follow the grievance process before imposing disciplinary sanctions. These steps may include supportive measures to ensure the restoration or preservation of equal educational access of the parties, protect safety, and deter sexual harassment without unreasonably burdening the other party. The process will be conducted by College officials who, at minimum, receive annual training on issues related to sexual misconduct.

Title IX Coordinator Responsibilities

Title IX Coordinator responsibilities include, but are not limited to:

  • Prepare and disseminate educational materials that inform members of the campus community of Title IX rights and responsibilities.
  • Coordinate in-service training to all employees and students concerning Title IX policy.
  • Receive and process, in a timely manner, inquiries from students, faculty, staff and administrators regarding rights and responsibilities concerning harassing behavior or other discriminatory behavior in violation of Title IX.

  • Coordinate the provision of support measures for the Parties.

  • If not appropriate for investigation, refer inquiries to other resources (e.g. Student Affairs, HRSTM)

  • Initiate grievance process for formal complaints alleging discrimination and/or harassment.

  • Notify Parties of their rights to pursue remedies outside of the College grievance process and rights under MC Policy -31001, Sexual Misconduct.

  • Monitor compliance of all requirements and time-lines specified in the complaint/grievance procedures.

  • Train staff responsible for implementing grievance procedures.
